Terms of Service

Services Addendum

 

“Beam” by Shentel refers to fixed wireless broadband internet access service brought to you by Shenandoah Cable Television, LLC, (“Shentel”, “we”, or “us”). As used herein, BEAM services may be referenced as “BEAM Services”. "You" or "your" refers to the holder of the account with Shentel. You agree that you are responsible for any user of the services and their compliance with the Service Agreement, this Addendum, and any relevant policies.

 

In addition to the terms and conditions of the services you receive from Shentel or its affiliates, including the Shentel Internet Terms of Service, Acceptable Use Policy, DMCA Policy, Privacy Policy, and Telephone Agreement, and additional policies incorporated by reference therein (collectively, the “Services Agreement’), the terms of this BEAM Services Addendum (the “Addendum”) apply to customers purchasing and/or receiving the BEAM Services. The terms of this Addendum, unless otherwise specified, will modify the terms of the Services Agreement with solely respect to the BEAM Services. The description of your services (including the BEAM Services) and other terms set forth in Beam - Internet by Shentel (iwantbeam.com) are incorporated by reference in this Addendum.

 

Changes to this Addendum. This Addendum, the Service Agreement, and any applicable policies incorporated by reference therein govern your relationship with us. We may modify this Addendum of the Service Agreement at any time. We will provide at least thirty (30) days’ notice before any material changes take effect. If you disagree with the changes to these Terms of Service, simply discontinue your use of the applicable services before the modifications take effect. Your ongoing use of any service after the changes take effect signifies your agreement to the new terms.

 

Network Management. Information about Shentel’s network management practices and speeds that you can expect to observe while using the BEAM Services can be found at https://www.iwantbeam.com/en/open-internet-disclosure

 

Availability of Services. BEAM Services are not available in all areas of Shentel’s network footprint.

 

Equipment. BEAM Services will require the following equipment to be installed at the service location: an outdoor antenna, J-arm, outdoor bracket, modem, internet router/WiFi equipment, and an analog telephone adapter (if voice service is purchased) which will require electrical power provided by you (collectively, the “Equipment”). We will remain the owner of the Equipment for the duration of your BEAM service, and each element of the Equipment, except as described below, must be returned by you in substantially the same condition as when you received it, ordinary wear and tear excepted, upon termination of the BEAM Services for any reason. If you do not return the WiFi Equipment or, as applicable, arrange for us to collect the WiFi Equipment from your service location within 45 days of termination of the BEAM Services, you will be charged replacement costs of the WiFi Equipment. Notwithstanding the foregoing, the J-arm and outdoor bracket (the “Outdoor Unit”) will become your property upon termination of the Beam Services for any reason. Upon termination, the Outdoor Unit will remain where installed at your service location, and you will be solely responsible for the care, maintenance and removal. It is important that only professionals perform maintenance, care, and removal of the Outdoor Unit. You acknowledge that we will not have any obligation or responsibility to uninstall or maintain the Outdoor Unit, and will have no liability to you or any third party relating to the Outdoor Unit. You agree to indemnify and hold Shentel and its subsidiaries, affiliates, officers, agents, licensors, employees, sub-contractors, and partners harmless from any claim or demand,, arising out of or related to the Outdoor Unit following termination of the BEAM Services, including, but not limited to, claims for personal injury, property damage, or degradation.

 

Installation. The outdoor antenna, power supply to the outdoor antenna, and the indoor equipment (collectively, the “Equipment”) will be professionally installed by us. You agree that you will not move, alter, disrupt, or modify any of the Equipment professionally installed by us at any time, and you will maintain electrical power to the Equipment at all times at your cost. If you have any issues with the Equipment, you may contact us at 1-888-412-2326. The installation process requires drilling of holes, installation of an external antenna on the side, eave, or roof of the home, routing of cables both outside and inside the home.  The routing and attachment of these cables will require them to be attached to the interior and exterior walls, and a connection to an appropriate grounding house location.  If you are not the owner of the service location, it is your responsibility to obtain any necessary permission from the owner of the service location prior to installation of the Equipment, and provide such written approval to the Installation Technician upon request. You agree to indemnify and hold Shentel and Shentel’s affiliates, assignees, officers, agents, licensors, employees, sub-contractors, and partners harmless from any claim or demand, arising out of or related to alleged unauthorized installation of the Equipment. You further agree that the Equipment is owned by Shentel, and Shentel reserves the right to recover or abandon the Equipment in its sole discretion.

 

Service Limitations. BEAM Services are fixed wireless internet services, which means that services are delivered via wireless cell sites to various fixed locations. Cell sites are subject to certain capacity limitations, so availability of services to a location prior to installation and commencement of services may change based on the number of customers being served by a particular cell site at any given time. We will do our best to give you advanced notice if service availability to your location changes between the time you order service and the services are to be installed. BEAM Services may be affected by changing foliage, weather, environmental changes, and problems with backhaul services, cell site outages, antenna damage, overuse, and other issues due to the nature of wireless services which are outside of Shentel’s reasonable control.

 

Usage Policies.  Because of the capacity limitations of a fixed wireless network, usage limitations apply to the BEAM Service in addition to the prohibitions and limitations set forth in Shentel’s Acceptable Use Policy (link above). These limitations are in addition to and not in lieu of the Acceptable Use Policy. We may take temporary or permanent action to enforce this Addendum and the Acceptable Use Policy, which may include suspension or termination of services. Prohibited uses generally include any activity that negatively affects the network or other users of the network, as well as actions that modify, impair, amplify, retransmit, or generate a radio frequency signal, compromises network security or capacity, and excessive use of the network in a manner that significantly increases congestion on the network.
